smart-product-people.com offers an application service that either creates application documents and cover letters based on customer information or, alternatively, revises and optimizes existing application materials provided by the customer.

§ 1 Conclusion of the Contract
When placing an order, you are submitting a binding offer to the Provider to enter into a contract with you. By clicking “Pay” during the order process, you place an order.
A legally binding contract between the parties is concluded when the customer commissions the Provider to perform a service, which the Provider accepts with an order confirmation.
Please note that the application documents created are individually tailored based on customer-provided materials and customized to the personal needs of the customer. Therefore, there is no 14-day right of withdrawal pursuant to § 312d Paragraph 4 Sentence 1 BGB.
The Provider reserves the right to decline to conclude a contract without stating a reason. Acceptance of the order is subject to the feasibility of performance. If performance is not possible, the Provider may withdraw from the contract without being liable for damages.
§ 2 Storage of Correspondence
The contract text of your order will be stored by the Provider. An order confirmation, including the order details you provided, will be sent to the email address you specified.
§ 3 Retention of Title
The delivered goods remain the property of the Provider until all claims have been fully paid.
§ 4 Prices and Withdrawal
In accordance with § 19 UStG, no value-added tax is charged, and it is therefore not displayed.
Requests for content changes must be reported within 7 days and include specific references to the relevant sections. You then have the option to request revisions within a reasonable timeframe.
§ 5 Delivery Conditions
Electronic delivery via email will be completed within 14 working days.
§ 6 Payment Conditions
Payment must be made in advance via PayPal or credit card. In exceptional cases, payment by invoice may be agreed upon. In such cases, the invoice amount must be transferred to the Provider’s account within 14 days of the invoice date.
For customers with a billing address outside Germany, payment in advance is the only accepted method.
§ 7 Usage Rights for Products
Upon purchasing a product, the customer may use it as often as desired for personal purposes but not for private distribution. Commercial use of the Provider’s products is also prohibited.
§ 8 Liability
The customer is solely responsible for adhering to all deadlines related to their application process. The Provider cannot be held liable for any damages resulting from the customer’s failure to meet deadlines. The customer is responsible for the accuracy of all content provided. The Provider cannot guarantee the success of a job search. Consequently, the Provider accepts no liability for the applicant's lack of success with the documents prepared by the Provider.
§ 9 Data Protection
All personal data is treated confidentially and in compliance with all applicable data protection regulations. Personal data will not be disclosed to third parties. The Provider reserves the right to contact the customer at a later date to inform them about the Provider’s offers. The customer may request the deletion of their data after the order is completed.
§ 10 Applicable Law
German law exclusively applies. For consumers, this choice of law applies only insofar as it does not restrict any mandatory legal provisions of the state in which the consumer resides or habitually resides.
§ 11 Confidentiality
The Provider is obligated to maintain confidentiality regarding all facts that become known to them in connection with their work for the Client. In particular, information concerning the Client's trade and business secrets must be treated as confidential and must not be used by the Provider for their own purposes outside the scope of the assignment or disclosed to third parties.
The obligation to maintain confidentiality extends beyond the termination of the contract.
The Provider is authorized to process the personal data entrusted to them within the scope and purpose of the assignment, or to have such data processed by third parties, in compliance with applicable data protection regulations.
§ 12 Salvatorische Klausel:
Sollten eine oder mehrere Bestimmungen dieser AGB rechtsunwirksam sein oder werden, so soll dadurch die Gültigkeit der übrigen Bestimmungen nicht berührt werden. Die ungültige Bestimmung wird schnellstmöglich durch eine andere Bestimmung ersetzt, die dem wirtschaftlichen Gehalt der rechtsunwirksamen Bestimmung am ehesten entspricht.
